Contract staffing is a legitimate and useful model. Informal contractor arrangements dressed up as contract staffing are a liability, and the liability usually lands on the principal employer rather than the intermediary.
What to verify before you engage a staffing partner
- 1Is there a written employment contract between the partner and the worker, not just a service agreement with you?
- 2Does the partner hold the relevant labour licences for the states you are deploying in?
- 3Are Provident Fund and ESIC contributions being made and remitted, with challans available on request?
- 4Is professional tax being deducted where applicable?
- 5Is there valid insurance covering the deployed worker?
- 6Are statutory registers and attendance records being maintained?
- 7Has background and document verification been completed before deployment?
Ask for evidence rather than assurance. A partner running this properly can produce challans and registers within a day. One that cannot is a risk you are carrying, not one you have transferred.
Why misclassification matters
Where a worker is engaged as an independent contractor but treated as an employee, fixed hours, direct supervision, company equipment, no other clients, authorities may look through the arrangement. The consequences typically include back-dated statutory contributions with interest, penalties, and in some cases a claim to employment status.
A contract staffing arrangement transfers work, not liability. Liability only moves if the compliance genuinely sits with the partner.
Getting the commercial structure right
A compliant contract staffing rate contains more than the worker's take-home pay. It includes employer statutory contributions, insurance, administration and the partner's margin. A quote materially below the market usually means one of those components has been omitted, and it is rarely the margin.
Plan conversion at the start
If there is any prospect of converting a contractor to permanent employment, agree the terms in the original contract. Negotiating conversion after eighteen months, when the person is embedded and you have no leverage, is a materially worse position.
